Description
James Diandre Pilot seeks review of a court of appeals decision affirming a jury verdict finding him guilty of attempted first-degree murder, attempted first-degree murder while committing criminal sexual assault, and first-degree criminal sexual assault. Pilot argues that he should be granted a new trial because the prosecutor committed prejudicial misconduct in his cross-examination of Pilot by repeatedly asking Pilot to characterize the states witnesses as lying in their testimony. Pilot also argues that: (1) the state presented insufficient evidence to support the jurys first-degree criminal sexual conduct verdict, (2) items seized from Pilots apartment should not have been admitted in evidence because the warrant authorizing the search was not supported by probable cause, and (3) the prosecutor committed prejudicial misconduct by failing to turn over semen evidence taken from the victim after her attack and hospital records concerning the victims post-attack physical therapy. We affirm.
